This privacy policy applies from 1 January 2021 and emanates from My Add On BVBA (hereafter My Add On), with registered office at 9300 Aalst, Leo de Béthunelaan 44/1, registered in the Crossroads Bank for Enterprises under the number 0676.537.782.

 

My Add On makes crutches and wheelchairs more comfortable through its products.

 

My Add On makes special efforts to protect (personal) data. During your contact with My Add On, you may share personal information of yourself, affiliated employees or business partners with us so that we can identify you as an individual, employee of a company, ... (such as names, e-mail address, address and telephone number). These are "personal data".

 

By using the site, entering into a contract or communicating your personal data to us with our services or when ordering a product, you accept the uses described in this Privacy Statement.

 

 

Processing of personal data

 

My Add On as Controller

 

 

Personal data are always processed in compliance with the principles of privacy legislation and the General Data Protection Regulation, being the European Personal Data Protection Regulation 2016/679 of 27 April 2016. The personal data are processed in a lawful, proper and transparent manner and this for a well-defined and explicit purpose: including logistics services and customer service in this regard.

 

Data processing is limited to what is appropriate and the retention period of personal data is limited to as long as necessary in relation to achieving the purposes of the processing. 

Personal data are appropriately secured by appropriate technical and organisational measures; My Add On processes your personal data, inter alia, for the following purposes:

 

• Customer management and customer service, possibly via platform with acceptance of terms of use;
• Provide information about our professional and social activities, or other similar subject that may concern you;
• To be able to contact you if necessary to perform our services;
• For further performance of agreements;
• Informing you of changes to our services and platforms;
• To deliver goods and services to you and optimisation/evaluation of the latter;
• Handling your payment;
• To fulfil legal obligations;
• When the legitimate interest of the company requires it, but this is always clear to the data subject;

 

You guarantee that the data you communicate is correct and complete.

 

My Add On will only disclose personal data to processors or affiliated companies if this is necessary for the performance of our agreement with you or to comply with a legal obligation or when the legitimate interest of the company requires it and this is compatible with the purpose of the processing and is done in a proportionate manner. You can request information about this from your contact person at the company. My Add On opts for partners that can guarantee the same level of security and confidentiality of your personal data.  

 

 

Other data is collected in an automated way by 'cookies' and other systems/applications that collect information. My Add On as a Processor

 

 

With regard to the processing of any personal data of the Customer, in certain cases the Customer may have the role of "Controller" and My Add On the role of "Processor", as described in the EU General Data Protection Regulation (EU 2016/679). Customer/professional partner's personal data is limited to any personal data provided in orders or personal data communicated in the context of evalutations, repairs or in the context of our services.  

 

My Add On shall process these personal data according to the customer's instructions and/or in accordance with the provision of the services from the agreement between My Add On and the customer, or as required by law, regulatory body or competent authority. In the latter case, My Add On shall inform the customer in advance to the extent possible, unless prohibited by the relevant law, regulatory body or competent authority.

 

The customer accepts that it is the primary controller of the processing of Personal Data and shall properly and correctly follow My Add On's processing. My Add On shall, taking into account the nature of the processing and the information available to it, assist the customer to the extent possible in enforcing the obligations under Articles 32 to 36 GDPR. The customer shall reimburse all such assistance services.

 

• Processing security assistance (Article 32 GDPR).
• Data breach assistance (Articles 33 and 34 GDPR) - My Add On shall inform the customer without unreasonable delay as soon as it becomes aware of a Personal Data breach.
• Assistance on a Privacy Impact Assessment (Articles 35 and 36 GDPR) - Where a type of processing presents a high risk to the rights and freedoms of natural persons, the client shall, prior to processing, carry out an assessment of the impact of the intended processing activities on the protection of personal data in accordance with Articles 35 and 36 GDPR.

 

Upon the termination of this Agreement, My Add On , if requested by the Customer, will immediately return or destroy the Personal Data and/or existing copies as far as reasonably practicable. My Add On will confirm that it has done so (except where a relevant law or Authority requires My Add On to retain a copy of the Personal Data). For the avoidance of doubt, nothing in this section requires My Add On to destroy copies of data it holds on its own behalf as a Controller.

Rights of the data subject

 

If you wish to consult, transfer, amend, correct, limit or delete your data, you may do so free of charge by sending an e-mail, subject to proof by means of a copy of your identity card, to the e-mail address info@myaddon.be . By this means and in the same way, you can also object to the processing of personal data or if you wish to terminate the communication. The data will be adjusted or deleted as far as possible and as technical possibilities allow. Your request will be dealt with as soon as possible. Your request will be met as much as possible, except if this proves impossible due to the company's interest or a legal obligation. If there is a data breach that threatens to violate your rights and the protection of your personal data, the supervisory authority will be notified and, in the event of a high risk to your rights and freedoms of natural persons, you will be informed as a data subject. 

 

Security and confidentiality

 

My Add On has developed security measures, adapted at technical and organisational level, to avoid the destruction, loss, falsification, modification, unauthorised access or erroneous notification to third parties of personal data collected on the website, as well as any other unauthorised processing of these data. Under no circumstances can MY ADD ON be held liable for any direct or indirect damage resulting from an erroneous or unlawful use by a third party of the personal data. All data are treated confidentially at all times.

Da liability of My Add On is always limited to the cases where the conduct of My Add On would constitute a major fault or fraud. The total liability of My Add On shall in any case not be able to exceed the total amount of costs paid by the customer/professional as determined in the relationship with the professional party with a maximum of 150 Euro and shall be limited to direct damages.

 

However, My Add On cannot be held liable for direct or indirect damage resulting from the use of the information on this site. Should you find any inaccuracies in the information made available via the site, please contact the site administrator.

Liability as a processor

 

The general provision on liability applies to the actions of My Add On in its capacity as Processor. The liability of My Add On is always limited to these cases specifically provided for in the GDPR. My Add On shall only be liable for the damage caused by processing when the processing did not comply with the obligations of the GDPR specifically addressed to Processors or acted outside or contrary to the legitimate instructions of the Controller and can be qualified as gross negligence or fraud. My Add On's liability in all cases is always limited to direct damages.

This privacy policy may be amended from time to time. Changes will take effect automatically after publication.

 

If, with regard to the processing of personal data, one of the preceding provisions is not valid, it will be replaced by a provision that approaches the underlying purpose of the proposed provision as closely as possible.
